These General Sales Conditions mentioned below (hereafter called “general conditions”) exclusively determine the contractual relations between the client using the website www.emboscada.pt (here called “user”), whose headquarters is at Praceta dos Pinheiros, 69, 4430-493 Vilar de Andorinho, Vila Nova de Gaia, Portugal. The general conditions are the sole ones to be applied and replace all other conditions, except under previous agreement, expressed in written. Emboscada may now and then amend certain provisions of its general conditions, hence being necessary to reread them every time you visit the website www.emboscada.pt. We consider that, once the order is validated, the user automatically accepts our general conditions. By accessing the website, the user complies with abiding by the General Conditions as well as the Conditions of Use. Regarding the purchases done to other traders, please check the Accession Conditions of the trading partners.

 

ORDERS AT THE EMBOSCADA.PT WEBSITE

To place an order at Emboscada, we provide you with three alternatives:
- Via Internet, at the website: www.emboscada.pt, 24/7
- Via phone: (+351) 914 105 017 from 10:00 to 13:00 and from 14:00 to 18:00, Monday through Friday (subject to e-mail confirmation)
- Via e-mail: loja@emboscada.pt The customer will receive a confirmation e-mail with the completed order.

 

INFORMATION ABOUT THE PRODUCTS

The photographs that illustrate the products are not part of the contractual scope and do not substitute any commitment on the part of Emboscada.
On the other hand, regarding the technical specifications and the product descriptions of our partners or suppliers, Emboscada declines any responsibility in terms of content validity.

 

PRICE

The selling prices shown at the website are in Euros, with fees and taxes included. The delivery costs, depending on the ordered products, will be borne by the customer and will be charged at the end of your purchase. These costs will be automatically calculated by the system for certain countries. Please note that, for the remaining countries, the delivery costs will be calculated and then confirmed to the customer via e-mail.
Emboscada reserves the right to change the prices at any time, yet tries to apply the rates in force at the time the customer placed the order.

AVAILABILITY

Emboscada respects an order’s deadline as long as there is stock availability. Should one of the requested items not be available in stock, Emboscada will contact the customer via e-mail or phone within 15 days tops, starting from the purchase date, so as to inform the customer about the product’s new delivery date.
However, if one of the ordered items is unavailable, Emboscada commits to propose similar products to the customer, within the same price range. In the event that the customer refuses this, Emboscada will proceed to refunding the goods, should it be necessary.

 

DELIVERY OPTIONS

The products purchased at the website are delivered within the European Union. Your order will be delivered at the address indicated by the customer at the moment of the purchase.
Emboscada provides 2 (two) delivery options:
Collect in store or via carrier to any destination.
Each shipment is accompanied by an envelope containing the following documents: Original Invoice and Duplicate. Product deliveries occur on working days, with no prior phone notice, and within the normal schedule. There are no deliveries outside business hours. Indicatively, without whatsoever binding Emboscada and except in the event of product unavailability in the market or any other given reasons of force majeure, the goods will be delivered according to the following time limits:

The delivery time varies according to the destination and it may add up 1-2 days for processing the order, please check here all the shipping times according to destination.
In case you do not receive the goods within the stipulated times, an investigation will take place with the carrier and it may take a few days.

The Customer should contact the Emboscada Customer Service and during this period no refunding will occur, since the loss of the goods will have to be verified and confirmed. At the moment of receiving the goods, the Customer has the right to open the package in order to check if the goods are in compliance with what was requested and if it does not show any external damages. In case the product is not the one ordered or should it present visible defects, Emboscada advises the customer to refuse the delivery. By refusing the delivery, the customer must write on the dispatch note what problem was detected and return the goods to the carrier, who will take care of the return. In the following 24 hours, you have to send an e-mail to Emboscada’s “Customer Service”, stating the detected issue. Once the package is delivered by the carrier, Emboscada is not accountable for any problems arising from transportation. Please note that Emboscada will be forced to refuse any refund or replacement request (right of withdrawal) for the goods that show external issues and that had been accepted by our customers at the moment of delivery. The right of withdrawal remains valid for cases of technical issues that are detected by the customer after the delivery and according to terms provided for by law.    


What to do in the moment of delivery:
1. Check if the package is in perfect conditions.
2. Open the package, asking the courier to await the checking (this is a right of the customer).
3. Check if the goods are in conformity with the order that was made and if it does not show visible defects. Should everything be in conformity, accept the delivery.
4. Should there be anything wrong, that is, an error with the ordered product, or any visible defect, you should refuse the delivery and fill in the dispatch note with the spotted issue.
5. Return the package(s) and all its content to the courier (carrier).

6. In the event of deliveries made by the carrier where no checking the goods took place, the customer will have 24 hours to issue the problem to our “Customer Service” via phone 22 7838431.

 

SAFE PAYMENT

The payment by bank transfer is submitted to the following conditions:
1. The bank transfer will have to be made within 1 (one) week starting at the moment the order was placed. After that timing, the order will be cancelled.
2. In order to simplify the handling of your order, when possible, do not forget, at the moment of the bank transfer, to state the order’s reference.
3. After the bank transfer is done, please send the transfer receipt copy to loja@emboscada.pt.
4. Once the order payment is confirmed, Emboscada will proceed to shipping the order to the provided address, which might take up to 24/48 hours.

 

ATM payment:

1. At the end of the order, the customer will receive an ATM reference and respective amount for the order.
2. After executing the task at the ATM, and after your payment is confirmed, the order will be shipped.

 

PayPal payment
For the customer with a PayPal account, this is a very simple payment method:
1. At the end of your order, please select the option PayPal and you will be redirected to the PayPal account, where with your access data you will be able to make the transfer of the amount to Emboscada.
2. Once the payment confirmation gets to Emboscada’s account, your order will be shipped.     

 

EasyPay Payment (ATM Reference, VISA and MASTERCARD)

1. At the end of the order please choose the EasyPay payment method and the necessary data will be provided in order to make the payment of your order.

2. In case you choose this payment method, Emboscada will automatically receive your payment receipt and your order will be shipped.

 

RIGHTS OF WITHDRAWAL. SATISFIED OR REIMBURSED

In order to exercise the right of withdrawal, the Customer will have to resend all the received goods via registered mail within the first 14 days starting at the day the Customer received the package. The goods must be new and complete (accessories, manuals…), and all goods must be sent back in the original packages.
This right to return can only be accepted for the products in their original state and complete (package, accessories, manual…) and in good conditions. Products returned incomplete, damaged or used by the customer will not be accepted. In case of exercising the right of withdrawal, Emboscada will do its best to reimburse the customer quickly, reminding however that this timing will depend on the technical assessments that will be performed to the material, with the duration of no longer than 15 days (starting at the arrival of the withdrawn goods to Emboscada).

 

RETURN

For the return of the package, the customer shall contact our Customer Service. The Customer is in charge of the shipping costs (the goods are carried under the customer’s responsibility).

 

WARRANTIES AND AFTER-SALES SERVICES

All sold products benefit from a two-year conformity warranty as of delivery of goods.
The Customer is in charge of the shipping fees of the product(s). Emboscada complies with carrying out any repairs with the suppliers. Regardless the issue with your product, it is necessary to send a copy of the invoice with the broken item.
Pay attention, warranty is not granted or merely partially granted to fixing problems resulting from an external cause to the apparatus (for instance, accident, impact, lightning, an outage…), the use or install that is not according to the manufacturer’s specifications, the detrimental use to the device’s proper preservation, the commercial or collective use, the use of inadequate peripherals, accessories or consumables. Should the repair not be accepted, the supplier will establish a budget.
The warranties of marketed products by Emboscada do not grant:
- consumables replacement
- abnormal or  non-compliant use of products
We ask you to carefully read the user’s manual provided with the products,
- damages connected to accessories.
- damages and consequences related to the intervention of a company not cleared by Emboscada, - damages and consequences related to the non-compliant use to which the product is intended (professional, collective use…)
- damages and consequences related to any external factor.
In no way can Emboscada be considered liable, should the supplier refuse to apply the warranty.
Should you not accept the budget established by the supplier, the latter can request the payment of administrative fees.
Should you accept the budget, you have to make a bank transfer corresponding to its amount.

 

DISPUTE AND RESPONSIBILITY

For the resolution of all and any dispute arising out of the interpretation or execution of these General Conditions, the jurisdiction will be determined by reference to the place of the Customer’s domicile. Should, however, the Customer be the one taking legal action, they can choose between the court of their domicile or the one where Emboscada is domiciled.      
Emboscada is not responsible for delays or contractual failures to comply for reasons of force majeure, disturbance, total or partial strike, postal services and means of transportation or communication, flooding, fire or war.
Emboscada is not responsible for any indirect damage, operating loss, loss of the benefit, loss of opportunity, damage or fees that might ensue from the fact of the purchase of any product presented on the website. Even though our products possess performances compatible with professional uses, Emboscada is not targeted for a professional audience.           
Emboscada will not thus see its responsibility compromised due to any damage that is a result of a professional activity.

 

PRIVACY POLICY

The data the customer provides at our website is indispensable for the processing of the order, for establishing invoices and warranty contracts; without them, the order will be automatically cancelled. By writing on our website, the customer vows to provide us with sincere and true information. The communication of false information is contrary to these general conditions, as well as to the conditions of use that are stipulated at our website. The customer has the permanent right to access and rectify all data that concerns them, according to the European regulations and the national Laws in force (Act No. 34 of the Law of January 6th 1978). The customer may at any moment request confirmation on the existence of their own personal data with Emboscada, and also request to change them. Promotional e-mails (electronic mails) with latest trends, clearance sales, exclusive offers, good deals, etc, will be sent to the customers. The customer can request to no longer receive e-mails from us at any time. Emboscada is the sole data-holder concerning the customers. Only Emboscada and their contractual partners can send information within the framework of precise and sporadic promotional operations.      These partners were specially chosen by Emboscada and are recognised for the quality of their products and services.

 

INTELLECTUAL PROPERTY RIGHTS

All the content of the Emboscada website (illustrations, texts, titles, brands, images, videos) constitutes property of Emboscada, their co-contracting parties or partners. The partial or total content reproduction through any procedure           and in any given medium is subject to the prior and expressed authorization by Emboscada. All information, contents, documents and software provided by our services are protected under international legislation, in what comes to intellectual property and copyright. Emboscada cannot authorise the copy, presentation or distribution of the contents to which you do not have the intellectual property rights. Any fraudulent use     of the rights attained by others constitutes a counterfeiting crime, severely punished by the Intellectual Property Law.
Emboscada will, under no circumstances whatsoever, be responsible for the violation of a user of rights attained by others and perpetrated by the activities of the latter on the website.
